1.About these terms
These Terms of Service ("Terms") govern your access to and use of Octodoro, operated by Max Marino trading as Octodoro, a sole trader based in the United Kingdom. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Octodoro.
2.Eligibility and your account
- You must be at least 13 years old, and old enough to use the service where you live.
- Please give accurate account information and keep your login details secure.
- You're responsible for activity that happens through your account.
- We may suspend or restrict accounts that break these Terms or create a security risk.
3.The service and changes to it
Octodoroprovides productivity and study tools, including optional social and AI features. We may update, add to, or discontinue parts of the service to improve quality, security, or compliance. Where a change materially and adversely affects a paid feature you're using, we'll give you reasonable notice and, where appropriate, the option to cancel.
4.Coins, diamonds and virtual items
- Coins are an in-app currency you can earn through use or buy. Diamonds are a premium in-app currency you buy with real money. Cosmetics and other virtual items can be obtained with them.
- Coins, diamonds, and virtual items are a limited, personal, revocable licence to use features within Octodoro. They are not your property, have no monetary value, and cannot be exchanged for cash or transferred outside the features we provide.
- Any in-app marketplace trades happen only within Octodoro using in-app currency. Prices and availability of items may change.
- We may add, change, or remove items, balances, or pricing where reasonably necessary (for example to fix errors or abuse), and will avoid removing items you have fairly bought except where the law or these Terms allow.
- If your account is closed for breaching these Terms, unused balances and items may be lost. This does not affect refunds the law requires us to give.
5.Premium subscriptions and payment
- Premium is a paid subscription processed by Stripe. Purchases of coins and diamonds are one-off payments processed by Stripe.
- The price, billing period, any free trial, and renewal terms are shown to you at checkout before you pay.
- When you subscribe, you authorise the recurring charge to your payment method until you cancel.
- You can manage or cancel your subscription at any time through the Stripe billing portal in your account settings; cancellation stops future renewals.
- We don't store your full card details — Stripe handles them directly.
6.Your right to cancel (consumers)
If you're a consumer, you normally have 14 days to cancel a purchase made online and get a refund, under the Consumer Contracts Regulations 2013.
Because premium access, coins, and diamonds are digital content/services delivered immediately, when you buy you ask us to start straight away and acknowledge that you lose the 14-day right to cancel once delivery or access begins:
- Coins and diamonds are delivered instantly, so the cancellation right ends at purchase.
- Premium access begins immediately (or when any free trial ends), so the cancellation right ends once access starts. You can still cancel renewals at any time.
If something you bought is faulty, not as described, or not delivered, you're entitled to a remedy under the Consumer Rights Act 2015 — contact us and we'll put it right. We may also offer refunds at our discretion.
7.Acceptable use
You agree not to:
- use the service for unlawful, abusive, fraudulent, or harmful purposes;
- attempt to bypass security, scrape data, or interfere with how the platform runs;
- exploit bugs, automate abuse, or manipulate progression, rewards, currency, or leaderboards;
- upload or share content that infringes others' rights or breaks the law.
8.Your content
You keep ownership of content you create (such as task text, reflections, and cosmetics you design). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display that content as needed to operate, secure, and improve the service — including showing items you list in the in-app marketplace to other users.
You confirm you have the right to share what you upload. We may remove content that breaks these Terms or the law.
9.AI features
- AI features are optional and rely on third-party providers.
- Please don't submit sensitive personal information in AI prompts or reflections.
- AI output may be inaccurate or incomplete and isn't professional advice.

10.Intellectual property
Octodoro and its software, design, branding, and content are protected by intellectual property laws. Except as these Terms allow or the law permits, you may not copy, distribute, reverse engineer, or create derivative works from them.
11.Third-party services
Some features depend on third-party services, including Google sign-in, Stripe billing, and OpenAI. Your use of those services may be subject to their own terms and policies.
12.Your statutory rights
Nothing in these Terms affects your statutory rights as a consumer, which cannot be excluded or limited. Under the Consumer Rights Act 2015, digital content and services we supply must be of satisfactory quality, fit for purpose, and as described. If they aren't, you may be entitled to a repair, replacement, or refund.
13.Disclaimers and our liability
We provide the service with reasonable care and skill, but it's offered on an "as available" basis and we can't promise it will always be uninterrupted, error-free, or perfectly secure.
We never exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your statutory consumer rights.
Subject to that, and because you're using Octodoroas a consumer, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, but we're not responsible for loss or damage that isn't foreseeable. To the extent permitted by law, our total liability to you for any claim relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.
14.Suspension and termination
You can stop using the service and close your account at any time. We may suspend or end your access if you break these Terms, where the law requires it, or to protect the service and its users — giving you notice where it's reasonable to do so. Ending your account doesn't remove any refund you're legally owed.
15.Governing law and disputes
These Terms are governed by the law of England and Wales. If you're a consumer, you benefit from any mandatory protections of the country you live in, and you can bring a claim in the courts there. Otherwise, the courts of England and Wales have exclusive jurisdiction.
16.Changes to these terms
We may update these Terms from time to time. We'll post updates here with a new "last updated" date. For changes that materially affect an ongoing paid subscription, we'll give you reasonable notice and the chance to cancel. Continuing to use Octodoro after an update means you accept the revised Terms.
